Buying property in Marbella — a guide for German buyers.

German citizens are one of the largest foreign buyer groups on the Costa del Sol, and Malaga has a long-established German resident community with its own schools, clinics, and professional services. As EU citizens, German buyers face none of the 90-day Schengen restrictions that affect UK buyers post-Brexit — full-time residence is available immediately. The DBA (Doppelbesteuerungsabkommen — double taxation agreement between Germany and Spain) governs how Spanish property income and gains are taxed across jurisdictions.

EU rights — what German buyers can do that non-EU buyers cannot

German citizens entering Spain exercise their rights under the Ley Orgánica 4/2000 (LOEX) implementing EU Directive 2004/38. The practical implications:

-- No 90-day limit: German residents can stay in Spain continuously without any Schengen calculation. The 90/180-day rule applies only to non-EEA nationals. -- Right to establish principal residence: German citizens can register as full-time residents in Spain without any prior authorisation. Registration is by empadronamiento at the local ayuntamiento plus registration in the Registro Central de Extranjeros (EU citizens' registry) for stays exceeding 3 months. -- NIE automatic from residency: the NIE (Número de Identificación de Extranjero) is issued as part of the residency registration process. No separate appointment required for EU citizens — the NIE emerges from the EU Citizens' Residence Certificate (Certificado de Registro de Ciudadano de la UE). -- Purchase without residency: German buyers can acquire property without becoming resident first — NIE can be obtained via the Spanish consulate in Germany without entering Spain. A power of attorney (Poder Notarial) allows legal representation at signing.

This is the most significant structural difference from UK post-Brexit buyers and non-EEA buyers: the German buyer choosing Marbella as a full-time residence has none of the immigration processing friction, no visa caps, and no time constraints.

The DBA — Germany-Spain double taxation agreement

Germany and Spain operate under the Doppelbesteuerungsabkommen of 3 February 2011 (BGBl. II 2012 S. 18). Its key provisions for property buyers:

Rental income: Spain has the right to tax rental income from property located in Spain. Germany also taxes the income, but credits the Spanish tax paid under Article 23 DBA. For German residents (steuerlich unbeschränkt steuerpflichtig), Spanish rental income must be declared on the German Steuererklärung under the Progressionsvorbehalt — it does not create additional German tax on the income itself but can push other German income into a higher bracket.

Capital gains on disposal: Spain taxes gains from Spanish property disposal at the Spanish rates (IRNR for non-residents; standard IRPF for residents). Germany recognises the exemption under Article 13 DBA for property gains — German residents pay no additional German capital-gains tax on the Spanish property gain (property gains are allocated to the state of location under the DBA).

Wealth Tax (Patrimonio): Spain-Germany DBA does not specifically address Patrimonio. German residents with Spanish property are subject to Patrimonio on Spanish assets at Spanish rates. Andalucia's 100% bonificacion for residents eliminates this for Andalucian-resident buyers; non-residents pay Patrimonio on Spanish assets at 0.2%-2.5% above €700,000.

Inheritance Tax (ISD): both Germany and Spain can tax on cross-border inheritance. The DBA does not comprehensively cover inheritance tax. German heirs (inheriting Spanish property from a Spanish-resident decedent) may face both German ErbSt and Spanish ISD obligations. The Andalucian 99% bonificacion reduces the Spanish leg to near zero; German ErbSt on Spanish property depends on the heir's German tax status. Cross-border inheritance planning with dual jurisdiction requires both a German Erbschaftssteuerberater and a Spanish abogado in the structure.

German tax residency shift and the Beckham Law

German buyers who shift tax residency to Spain (by spending 183+ days per year in Spain) exit German steuerlich unbeschränkt steuerpflicht for the portion of the year they are no longer German-resident. The DBA Article 4 definition of resident applies.

The German Wegzugsbesteuerung (exit tax under Section 6 AStG — Aussensteuergesetz) is the critical consideration. Germany levies a deemed-disposal tax on accrued unrealised gains in shares of corporations in which the departing individual holds a 1%+ stake. For German buyers with significant German GmbH or AG shareholdings, the Wegzugsbesteuerung can be material. Professional German tax advice (Steuerberater with international mandate) is essential before completing the change of centre of vital interest.

Once Spanish-resident, the Beckham Law (Article 93 LIRPF) is available to German buyers who qualify through employment, enterprise, or digital-nomad status. The flat 24% IRPF rate on Spanish-sourced income for 6 years is a significant advantage for buyers with Spanish employment income; for buyers with primarily passive foreign income, the tax position depends on the income source and treaty allocation.

German-language services and schools in Marbella

Marbella and the broader Costa del Sol have substantial German-language infrastructure, reflecting the community's long history on the coast.

Schools: -- Deutsche Schule Malaga: German state-accredited school in Malaga offering the full German curriculum including Abitur. Day school; buses from Marbella area. The school follows the NRW (Nordrhein-Westfalen) curriculum and produces qualifications fully recognised by German universities. -- International schools with German tracks: several of the English-curriculum international schools on the Costa del Sol have German-speaking teaching staff and can accommodate German curriculum elements. Aloha College (Marbella) is frequently used by German families transitioning.

Legal and advisory: -- Several Marbella law firms operate with German-qualified lawyers or German-speaking abogados. Firms with strong German client bases include established practices on Calle Ramón y Cajal and in the Marbella Golden Mile commercial zone. -- German-speaking real estate advisors: Muse Selection operates in English, Spanish, and Russian, and maintains referral relationships with German-fluent independent consultants for clients who require full German-language support throughout the process.

Healthcare: the Hospital Quironsalud Marbella, Hospital HC Marbella, and several private clinics operate with German-speaking staff or German-insurance direct billing. Most German Krankenversicherung (particularly PKV — private health insurance) provides direct cover in Spain.

Practical purchase process for German buyers

The sequence for a German buyer purchasing a Marbella property:

1. NIE: Obtain via the Spanish consulate (Generalkonsulat) in the German city of residence. Primary consulates for this are Madrid embassy / Frankfurt, Munich, Hamburg consulates. Alternatively, obtain in Spain at the Comisaria Nacional de Policía with a prior appointment (cita previa). Standard processing: 2-6 weeks. The NIE is required before signing any private purchase contract.

2. Spanish bank account: Not strictly required before purchase (funds can be wired directly to the notary's client account), but advisable for ongoing IBI and utility payments. Spanish banks require in-person KYC for non-residents; Santander, BBVA, and CaixaBank private banking arms accept appointments in Germany for high-net-worth German clients.

3. Legal due diligence: the buyer's abogado performs standard checks (Nota Simple from Registro de la Propiedad, outstanding IBI balance, community debts, urban planning compliance at Gerencia de Urbanismo Marbella). German buyers frequently use German-speaking Spanish lawyers for comfort, though the Spanish qualification is what matters legally.

4. Contrato de arras: private purchase contract, typically 10% deposit. Legally binding; withdrawal forfeits the deposit.

5. Notarial signing (escritura): balance payable, ITP or IVA paid within 30 days. NIE required for both parties.

6. German registration considerations: German buyers who spend significant time in Spain should review their Anmeldung status. If the Spanish property becomes the centre of vital interest (primary residence), the German obligation to maintain Anmeldung may technically cease — though many German buyers maintain dual registration for practical reasons. Individual advice from a Steuerberater is required.

Marbella zone recommendations for German buyers

German buyer patterns on the Costa del Sol, based on the Muse desk's experience, cluster in three distinct zones:

Sierra Blanca: the most popular zone for German families relocating as primary residents. Gated, safe, proximity to Deutsche Schule Malaga via school bus, southern sea-view orientation, no commercial activity within the gated perimeter. The 350-villa register is built out; all transactions are secondary market.

Nueva Andalucia (Golf Valley): golf-oriented German households — high prevalence. Proximity to Las Brisas, Los Naranjos, and Aloha Golf courses on walking distance, value relative to Golden Mile pricing, good connectivity to Aloha College and international schools. The zone median (€8,542/m² asking, H1 2026) is the value case: comparable residential quality to the Golden Mile and Sierra Blanca at a lower per-square-metre asking level.

Benahavis (La Zagaleta): German buyers with privacy requirement and higher budget. La Zagaleta has a meaningful German community, partly because the estate's early buyer base in the 1990s included several German industrialist families. Introductions within the La Zagaleta community often happen through existing German-resident owners.
